DESCRIPTION:\nThis presentation will explore real‑world scenarios in which surviving spouses in blended families sought to re‑write estate plans after a spouse’s death—often by exploiting discretionary authority, exerting pressure on individual trustees, or challenging fiduciary decisions. The presentation will examine common warning signs in planning and administration that create opportunities for conflict, including ambiguous distribution standards, poorly defined trustee powers, and inadequate checks and balances.\n \nThe session will also highlight proactive strategies to reduce risk, such as thoughtful trustee selection, the use of corporate fiduciaries to provide neutrality and continuity, clear articulation of intent, and mechanisms to protect remainder beneficiaries. The goal is to equip advisors with practical tools to help clients preserve the integrity of their estate plans, minimize family conflict, and avoid costly, emotionally charged litigation.\n \nThe presentation will be delivered by Katie Yoder of BMO Wealth Management and Dan Logan of BMO Private Bank's Estate Settlement Services.  Katie Yoder's bio is attached.\n \nDan Logan is a Vice President and Director of BMO Bank’s Estate Settlement Services.  Prior to joining BMO, Dan had his own legal practice in Chicago for over 20 years, focused mainly in the areas of estate planning and estate administration for high net worth individuals and families.  This work included advising clients on various techniques for wealth transfers, charitable planning and advising on income and transfer taxes.  Dan received his B.A. from the University of Illinois – Chicago, his J.D. from DePaul University’s College of Law and his M.B.A. from Northwestern’s Kellogg School of Management.\n
